Terms of use of the ScriptWise Registry

1. The service
ScriptWise ("the Registry") is a central record of prescription fills for the Cayman Islands. It lets a pharmacist see what a patient has already been dispensed across participating pharmacies before dispensing again, lets prescribers register patients and issue scripts, and gives the Ministry of Health patient-anonymous oversight of dispensing trends.
The Registry is a decision-support tool, not a substitute for professional judgment. Duplicate-fill warnings, refill-due lists and any other indicators are calculated from the records Users have entered. They may be incomplete — for example where a fill was made outside the participating network — and the dispensing decision, and responsibility for it, remains with the pharmacist.
2. Accounts and access
- Access is granted to named individuals in a professional role. Accounts are provisioned by an administrator or, where enabled, by self-registration with a confirmed email address.
- You must keep your credentials confidential, must not share an account, and must enable two-factor authentication where your organisation or role requires it. You are responsible for all activity under your account.
- Tell your administrator immediately if you believe your account has been compromised.
- Your organisation's administrator controls which pharmacy or practice locations your account is mapped to. Records you create are attributed to your account and your current location.
3. Acceptable use
You may use the Registry only for the care of patients you are dispensing to or prescribing for, and for administrative or oversight functions your role authorises. In particular you must not:
- look up a patient's record without a legitimate dispensing, prescribing or care reason;
- disclose, copy, export or retain patient information from the Registry beyond what your care role requires;
- enter information you know to be false, or alter records to misrepresent what was dispensed;
- attempt to access records, screens or functions outside your role, or to probe, disrupt or reverse-engineer the service;
- use automated tools against the Registry other than integrations we have approved.
Access is audited. Every access to a patient record is logged against your registration. Misuse may result in suspension of access and referral to your professional regulator or to law enforcement.
4. Accuracy of records
Users are responsible for the accuracy and timeliness of what they enter — patient details at registration, and medication, quantity, days' supply and prescriber details at each fill. Because other pharmacies rely on these records to protect the same patient, a fill should be recorded at the time it is dispensed. The Registry rejects exact duplicate records automatically and flags overlapping supply, but cannot correct entries that were wrong when made; correct errors promptly through the appropriate screen or by contacting support.
5. Data protection
Personal data in the Registry is handled as described in our Privacy Policy, which forms part of these terms. Each participating pharmacy and practice remains a data controller for the records it holds in its own systems and is responsible for its own compliance with the Data Protection Act (2021 Revision), including informing patients that dispensing is recorded in a central registry.
6. Fees
Participating pharmacies are billed for use of the Registry as set out in their participation agreement, typically per script fill recorded. Billing statements are issued monthly and contain no patient information. Fees, if any, for prescriber or Ministry access are set out in the relevant agreement.
7. Availability and support
We aim to keep the Registry available at all times but do not guarantee uninterrupted access. Planned maintenance will be notified where practicable. If the Registry is unavailable, Users should follow their organisation's usual dispensing procedures and record fills when service resumes.
8. Intellectual property
The Registry software, design and documentation are the property of the operator and its licensors. Users receive a non-exclusive, non-transferable right to use the service for its intended purpose for the duration of their authorised access. Records entered by Users remain the responsibility of the contributing organisation as described in section 5.
9. Liability
To the fullest extent permitted by law, the operator is not liable for clinical decisions made by Users, for records that are incomplete because a fill was not entered or was made outside the participating network, or for indirect or consequential loss arising from use of or inability to use the Registry. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Suspension and termination
We may suspend or withdraw an account, or an organisation's participation, for breach of these terms, for security reasons, or where required by law or a regulator. An organisation may end its participation on the notice set out in its participation agreement. Records already contributed to the Registry remain in it for the benefit of patient safety, subject to the retention and erasure provisions of the Privacy Policy.
11. Changes to these terms
We may update these terms as the Registry evolves. The effective date above identifies the current version; material changes will be notified to Users at sign-in and continued use after notice constitutes acceptance.
12. Governing law
These terms are governed by the laws of the Cayman Islands and the courts of the Cayman Islands have exclusive jurisdiction over any dispute arising from them.
